In this article, the right to health is discussed as a social right and an essential requisite in the construction and guarantee of human rights, more precisely human dignity, considering this right as a complex but effective process in the transformation of the social reality. In the first place, the activities of the public power and its difficulties to guarantee universal access to health are highlighted. This scenario ends up inhibiting the practice of the right to health and prevents users (...) from enjoying and using it. In that sense, this article challenges and explores some alternatives to solidify and put in practice the right to health in Brazil. Departing from the analysis of the Unified Health System and social participation in Brazil, this article discusses the judicialization of health in the country, highlighting the difficulties the State faces to equitably offer universal healthcare to society. This context offers an opportunity for reflection and a paradigm change, from the “judicialization of health” to the “judicialization of health policies.” Finally, the public health policies adopted by other countries are emphasized, in the attempt to construct the empowerment of human beings in the practice of their rights, particularly social participation and the discussion about the States’ responsibility to put their citizens’ right to health in practice. In conclusion, the political and collective construction of the right to health needs to be encouraged, distinguishing the legitimate interests of the different interlocutors involved. (shrink)

New paradigms in the psychology of reasoning have included a consideration for general contextual factors that may impact on the reasoning process, including individuals’ goals and motivations. We suggest that emotions are one such important contextual factor that influences reasoning. The classic literature on thinking and reasoning has typically ignored the possible influence of emotion, except to consider it a source of disruption. We review findings from studies where participants were asked to reason about personally relevant emotional experiences such as (...) sexual abuse, war, and terrorist attacks. While some findings are consistent with the view that incidental emotions have a deleterious effect on reasoning, a number of findings also suggest a beneficial impact of emotion. For instance, veterans reasoned more logically about combat-related syllogisms than structurally identical syllogisms with neutral contents; victims of sexual abuse reporting more negative emotions following the events also reasoned more logically on abuse-related contents, relative to neutral contents. This may be associated with integral emotions, when the affective reaction is relevant to the semantic contents reasoned about. We propose that the positive impact of integral emotions on reasoning can be explained by increased utility of problem content and increased utility of reasoning. (shrink)

How can a collective pay attention virtuously? Imagine a group of scientists. It matters what topics they pay attention to, that is, which topics they draw to the foreground and take to be relevant, and which they leave in the background. It also matters which aspects of an investigated phenomenon they foreground, and which aspects they leave unnoticed in the background. If we want to understand not only how individuals pay attention of this kind virtuously, but also collectives, we first (...) need a framework to understand virtuous collective agency. A result of this article will be that virtuous collective action depends on the collective being institutionalized. At the same time, we have to think of the constituents of the collective in terms of practical identities (as opposed to individuals). This is what enables us to understand how a collective can acquire the stability required for virtue, and how we don’t end up with a summative account of group virtue, respectively. It will be argued that collectives only have the required stability in their actions when their commitments are habitualized in the form of institutionalized procedures. An Aristotelian understanding of virtue distinguishes between commitment, inclination, and action. Only when a subject’s inclination is fully lined up with her commitment, do we arrive at the required stability (of character) for virtuous action. In the case of individuals, to build up an appropriate inclination consists in an inscribing of the commitment into the feelings and body of the subject. If a commitment is fully ‘embodied’ in this sense, it has formed the individual’s inclination accordingly. How can one make sense of this in the case of collective subjects? This article tries to show that for collectives, the embodiment of commitment (the forming of the fitting inclinations) consists in creating policies, procedures, and rules that stabilize the acting according to the commitment, irrespective of the motivation of each individual involved in the collective. Hence, embodiment of commitment, in the case of collectives, is institutionalization. The article then explores what this requirement of institutionalization means for collective attention. The illustration will draw on a distinction between focused and open-minded attention. It will be shown that for either case – focused and open-minded – in order for a collective to pay attention virtuously, it needs to have its commitments institutionalized. (shrink)

Biobanks correspond to different situations: research and technological development, medical diagnosis or therapeutic activities. Their status is not clearly defined. We aimed to investigate human biobanking in Europe, particularly in relation to organisational, economic and ethical issues in various national contexts. Data from a survey in six EU countries were collected as part of a European Research Project examining human and non-human biobanking. A total of 147 institutions concerned with biobanking of human samples and data were investigated by questionnaires and (...) interviews. Most institutions surveyed belong to the public or private non-profit-making sectors, which have a key role in biobanking. This activity is increasing in all countries because few samples are discarded and genetic research is proliferating. Collections vary in size, many being small and only a few very large. Their purpose is often research, or research and healthcare, mostly in the context of disease studies. A specific budget is very rarely allocated to biobanking and costs are not often evaluated. Samples are usually provided free of charge and gifts and exchanges are the common rule. Good practice guidelines are generally followed and quality controls are performed but quality procedures are not always clearly explained. Associated data are usually computerised. Biobankers generally favour centralisation of data rather than of samples. Legal and ethical harmonisation within Europe is considered likely to facilitate international collaboration. We propose a series of recommendations and suggestions arising from the EUROGENBANK project. (shrink)

This paper is a response to the opening of new lines of research on CSR and SMEs (Thompson & Smith, 1991; Spence, 1999; Moore & Smith, 2006; Spence, 2007). It seeks to explore the business case for CSR in this corporate segment. The paper, which is based on four case studies of medium-sized firms in the automotive sector, took the distinctive approach of trying to understand the nature of CSR-like activities developed not by best-in-class CSR-driven companies but by purely competitiveness-driven (...) firms. The case studies provide explicit evidence that the CSR activities of SMEs and the notion of social capital are interrelated, turning social capital into a powerful instrument to better explain what academic literature has called silent CSR practices . The analysis that follows questions some of the basic tenets that underpin the branch of business ethics that deals with the nature of SMEs' approach to CSR. Four basic concerns, which take the form of propositions for further research, serve as the basis for this analysis: a) A definition of CSR that includes most of the actions taken by all companies in the territory contributes no academic value to the discipline b) Any study of the motivation behind these CSR actions must reflect their essentially pragmatic nature. Actions are linked to social values but also, more importantly, to the nature of the competitive environment c) Business ethics must seek common ground with other more sociological disciplines if it is to explain the reasons behind this type of action d) Any study of this kind of practice requires a dual approach: a) normative when using tools developed by CSR; and b) descriptive and instrumental using the notion of social capital. Participation of the Public in Science: Towards a New Kind of Scientific Practice Participation of the public in science has been the object of an increasing number of social and political philosophical studies, but there is still hardly any epistemological study of the topic. While it has been objected that involvement of the public is a threat to the integrity of science, the apparent indifference of philosophers of science seems to testify to its lack of relevance to conceptions of scientific (...) activity. I argue both that it is not a threat to science and that it is relevant to philosophy of science by showing that it constitutes a new kind of epistemic practice. Two main objections to the idea that the involvement of non-scientists, with their situated perspective and contextual values, can form an epistemic practice will be addressed: the first bears on the epistemic potentialities of the cooperation between scientist and non-scientists; the second on the possibility that this cooperation takes the form of a practice. This book promotes the research of present-day women working in ancient and medieval philosophy, with more than 60 women having contributed in some way to the volume in a fruitful collaboration. It contains 22 papers organized into ten distinct parts spanning the sixth century BCE to the fifteenth century CE. Each part has the same structure: it features, first, a paper which sets up the discussion, and then, one or two responses that open new perspectives and engage in further reflections. (...) This memorial to Latour is not an appraisal of his fifty-year research career but the report of a traveling companion with a story to share about the apparent lack of continuity, the sudden, unapologetic, unprincipled changes of position, with which he surprised or scandalized his colleagues and readers. In the first place, was he a sociologist, an anthropologist, a philosopher? Though he did not make lasting commitments of that kind, he did make deeper ones that did not change—above all, never (...) to explain anything in terms of something more general and, thus, never to accept the position of judge. To follow Latour's problematic changes—sometimes referred to as his “versatility”—demands that we follow the changes of the very terms of the problems that his basic commitment bound him to confront. From the 1980s, when his work dealt with technoscientific progress, to the years of his growing concern with political ecology, and finally to his recognition of the oncoming climate chaos, dizzying leaps were entailed by his resistance to the temptation of judging. Involved in, but never the cause of, various of his leaps, Stengers describes her friend as responding, perforce, to changing times, rather than as behaving like a theorist thinking mainly of his image, reputation, and career. Depuis qu'elles existent, les sciences dites exactes se prétendent différentes des autres savoirs. Comment comprendre cette prétention? Faut-il, à la manière des épistémologues anglo-saxons ou de Karl Popper, tenter d'identifier les critères qui la justifient? Peut-on, suivant le modèle nouveau des études sociales des sciences, y voir une simple croyance? Ce livre propose un dépassement fructueux de l'opposition, apparemment irréconciliable, entre ces deux approches des sciences. Et si la tension entre objectivité scientifique et croyance était justement constitutive des sciences, enjeu (...) des pratiques inventées et réinventées par les scientifiques? A partir de concepts élaborés par Paul Ricoeur, la troisième partie articule morale, éthique et théologalité. Loi et désir sont pensés en lien avec la Règle d'or. La revalorisation de l'hétéronomie offre alors une perspective nouvelle pour donner sens à la grâce. Les notions d'attestation-conviction, d'imputabilité, de responsabilité et de reconnaissance permettent ensuite de développer l'identité du sujet éthique chrétien. In this article, we seek to explore the different normative claims made around commons organizing and how the advent of the digital commons introduces new ethical questions. We do so by unpacking and categorizing the specific ethical dimensions that differentiate the commons from other forms of organizing and by discussing them in the light of debates around the governance of participative organizations, the cornerstone of commons organizing (Ostrom in Governing the commons: the evolution of institutions for collective action. Cambridge University (...) Press, Cambridge, 1990). Rather than contesting commons organizing or endorsing it blindly, our goal is to critically reflect on its deontological and instrumental assumptions, and analyze the arguments upholding that it possesses ethical qualities that render it fairer, more equitable and sustainable than other centralized or hierarchical models—as well as any forms of privatization. We conclude by assessing the definitional dislocation of the digital commons where, unlike traditional commons, extractability can be endless and generate unintended consequences such as commodification or alienation. Taking stock of recent debates around the digital commons, we open the debate for future possible research avenues on normative claims, particularly under rapidly changing technological conditions. In critical reaction to the ‘tribunal view’ on experiments, this essay will show the constructive contribution of experimental activity to the processes of modeling and simulating. Based on the analysis of a case in fluid mechanics, it will focus specifically on two aspects. The first is the controversial specification of the conditions in which the data are to be obtained. Although the mapping between form and meaning is often regarded as arbitrary, there are in fact well-known constraints on words which are the result of functional pressures associated with language use and its acquisition. In particular, languages have been shown to encode meaning distinctions in their sound properties, which may be important for language learning. Here, we investigate the relationship between semantic distance and phonological distance in the large-scale structure of the lexicon. We show evidence in 100 languages from a (...) diverse array of language families that more semantically similar word pairs are also more phonologically similar. This suggests that there is an important statistical trend for lexicons to have semantically similar words be phonologically similar as well, possibly for functional reasons associated with language learning. The current crisis has come at a cost not only for big business but also for business schools. Business schools have been deemed largely responsible for developing and teaching socially dysfunctional curricula that, if anything, has served to promote and accelerate the kind of ruthless behavior and lack of self-restraint and social irresponsibility among top executives that have been seen as causing the crisis. As a result, many calls have been made for business schools to accept their responsibilities as social (...) institutions and to work toward becoming more socially embedded and better attuned to public interests. In this paper, however, we point to some of the barriers there may be in the way of business schools developing into responsible organizational citizens proper. We argue that there are lines of resistance against responsibilization operating at epistemological, institutional, and organization levels and that we need to take account of barriers on all these levels in order to properly capture the challenges that are involved in making the modern business school amenable to demands for more social responsibility. In terms of working toward overcoming such barriers, we discuss how business education can become more socially embedded via the inclusion of ethical reflection and critical thinking. (shrink)

A long‐standing debate in the study of human communication centers on the degree to which communicators tune their communicative signals (e.g., speech, gestures) for specific addressees, as opposed to taking a neutral or egocentric perspective. This tuning, called recipient design, is known to occur under special conditions (e.g., when errors in communication need to be corrected), but several researchers have argued that it is not an intrinsic feature of human communication, because that would be computationally too demanding. In this study, (...) we contribute to this debate by studying a simple communicative behavior, communicative pointing, under conditions of successful (error‐free) communication. Using an information‐theoretic measure, called legibility, we present evidence of recipient design in communicative pointing. The legibility effect is present early in the movement, suggesting that it is an intrinsic part of the communicative plan. Moreover, it is reliable only from the viewpoint of the addressee, suggesting that the motor plan is tuned to the addressee. These findings suggest that recipient design is an intrinsic feature of human communication. (shrink)

This paper aims 1) to introduce the notion of theoretical story as a resource and source of constraint for the construction and assessment of models of phenomena; 2) to show the relevance of this notion for a better understanding of the role and nature of values in scientific activity. The reflection on the role of values and value judgments in scientific activity should be attentive, I will argue, to the distinction between models and the theoretical story that guides and constrains (...) their construction. The aim of scientific activity is to develop understanding of phenomena, and something that serves this aim and contributes to the development of understanding has a cognitive value. Cognitive values are the features that something that plays a role in scientific activity should have so that it can serve its aim. La hagiografía medieval tenía una importante función didáctica. Estos relatos fueron muy útiles para la Iglesia ya que permitían transmitir valores, modelos de conducta e ideas complejas a los feligreses. En este trabajo de investigación exploraremos tres obras hagiográficas en verso redactadas en distintas zonas de la Península Ibérica durante el siglo XIII, protagonizadas por tres santas que representan modelos diferentes (mártires, religiosas y penitentes). A través de este estudio comparativo hemos podido observar que, más allá de los tópicos asociados (...) a cada modelo de santidad, los valores transmitidos como ejemplo de “buenas cristianas” se repiten en todos ellos como condición necesaria para que la mujer alcanzase la salvación eterna: mantenimiento de la virginidad, castidad, penitencia y purga del pecado. Así, podemos concluir que la hagiografía femenina plenomedieval tuvo un importante papel en la transmisión y asentamiento de las ideas del clero respecto a lo femenino, cargadas de una evidente misoginia. La existencia de representaciones del cuerpo, en especial aquellas que se requerirían para actuar, ha sido objeto de largas controversias. El objetivo de este artículo es defender la idea de que hay representaciones del cuerpo involucradas en la realización de acciones cotidianas. Nuestra tesis será que lo que realmente muestran algunas dudas sobre este tipo de representaciones es que deben tener cierto tipo de contenido no-conceptual. Primero, abordamos dichas dudas, mostrando que no refutan la existencia de las representaciones en cuestión. (...) Sin embargo, señalamos que contienen dos intuiciones clave para cualquier caracterización del contenido de dichas representaciones. Así, pasamos a proponer una caracterización tal, que acomode adecuadamente las intuiciones señaladas. Making reason and revelation agree, notably by defining the former’s subordination to the latter, was one of the main concerns of European Medieval scholasticism; and from the tension between the weight of scriptural authority and the aspiration to the independence of rational inquiry finally emerged in Europe a philosophical field free of any allegiance to a revealed discourse – or at least pretending to be so – and castigating the old “scholastic method”. In India, by way of contrast, the philosophical (...) field has remained essentially scholastic inasmuch as most philosophical systems never ceased to acknowledge scripture (āgama) as a means of valid knowledge, and even often asserted its supremacy over reason and experience. Yet, just as European scholasticism cannot be reduced to the image of it that has prevailed since Descartes, the relationship between scriptural authority and rational enquiry in India is much more complex than might appear at first sight. It is first and foremost in order to defend their respective scriptures that various Indian religious currents chose to engage in philosophical debates; but this apologetic intention paradoxically led their champions to set aside scriptural authority. The paper points out this strange process of philosophical emancipation, born of apologetic concerns and nourished by them; and by comparing two apparently diametrically opposed definitions of the relationship between reason and revelation – that of the Buddhist Dharmakīrti, and that of the Śaiva nondualist Utpaladeva –, it aims at showing that although the Indian philosophical field never acquired the autonomy (real or proclaimed) that has characterized Western philosophy from the 17th century onwards, it grew in a constant creative tension between the acceptance and rejection of scriptural authority. The article is built in twelve remarks posing and arguing the “choice of not to”: not to enter the systematics of Joas’ essay and Joas’ thought about what he conceives as “the powers of the sacred”. The discussion is based on the introduction to the book and the preface to its French translation, remaining in a multidisciplinary references field, external to the Joasian systematics. It is not about the terms of the debate, nor about the debate concerning the Weber’s concept (...) of disenchantment and its reception. On the contrary, all along the threshold pages of Joas’ essay, the argument consolidates its discussing exteriority, without seeking or claiming to invalidate Joas’ thesis. The choice of not to, as a way of thinking attempted here, is closer to the Taubesian “discordant accord” figure, than that of the Weberian “elective attraction”, which, moreover, Joas takes over in his own way. What is at stake is not to subscribe to the anachronistic invalidation of a modern self-understanding that was effective, which indeed does not solve the question of thinking how it is outdated today. It is also not to subscribe to think the extreme effective plurality of the religions on the bases of two unifying notions, the political and the (in fact too particular) notion of “sacred”. (shrink)
